1. Acceptance of Terms

By accessing, installing, and using the Nyimbo Za Kristo application (the "App"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to all the terms and conditions, you should not use the App. Your continued use of the App after any modifications to these Terms constitutes your acceptance of such modifications.

2. License and Permitted Use

2.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal Android device for your personal, non-commercial use. This license does not include the right to:

• Modify or create derivative works
• Distribute, sublicense, or resell the App
• Reverse engineer, decompile, or attempt to derive the source code
• Remove or alter any proprietary notices or labels
• Use the App for any illegal or unauthorized purpose

2.2 Restrictions

You agree not to:

• Use the App in violation of any applicable laws or regulations
• Transmit any harmful, malicious, or disruptive content
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality or servers
• Use the App to engage in harassment, abuse, or discrimination
• Remove, alter, or obscure any copyright, trademark, or proprietary notices

3. Intellectual Property Rights

3.1 Ownership

The App, including all content, features, and functionality, is owned and operated by Rwimbo Solutions Inc. All content in the App, including text, graphics, logos, hymn notations, audio recordings, and software, is protected by copyright, trademark, and other intellectual property laws.

3.2 Hymn Content

The musical compositions, arrangements, and notations available through the App are licensed from various composers and publishers. You may use this content exclusively through the App in accordance with your subscription tier. Reproduction, distribution, or public performance outside the App is strictly prohibited without explicit permission.

3.3 User Feedback

Any feedback, suggestions, or ideas you provide regarding the App may be used by us without compensation or obligation to you.

4. User Accounts

4.1 Registration and Responsibilities

To access certain features of the App, you may be required to create an account. You are responsible for:

• Providing accurate, current, and complete information
• Maintaining the confidentiality of your password
• Notifying us of any unauthorized access or use of your account
• All activities that occur under your account

4.2 Account Termination

We may terminate or suspend your account at any time for violation of these Terms or for any reason without prior notice. Upon termination, your right to use the App ceases immediately.

5. Content and Services

5.1 App Content

We strive to maintain accurate and up-to-date content in the App. However, we make no warranty regarding the accuracy, completeness, or timeliness of the hymn notations, audio recordings, or other content. Content may be updated, modified, or removed at our discretion.

5.2 Availability

The App is provided on an "as is" basis. We do not guarantee uninterrupted or error-free service. We may perform maintenance, updates, or make changes to the App that may temporarily affect availability or functionality.

5.3 Third-Party Content

The App may include links to or content from third-party websites and services. We are not responsible for the accuracy, legality, or quality of third-party content. Your use of third-party services is subject to their terms and conditions.

5.4 Disclaimer of Responsibility

You acknowledge and agree that Rwimbo Solutions shall not be responsible or liable for any damage or loss caused by or in connection with the use of or reliance on any such content, goods, or services available through any third-party websites or services.

6. Subscriptions and Payments

6.1 Subscription Terms

Certain features of the App may require a subscription. By subscribing, you agree to pay the subscription fee, along with any applicable taxes, for the subscription period selected.

6.2 Automatic Renewal

Your subscription will automatically renew at the end of the subscription period unless you cancel it before the renewal date. You can cancel your subscription at any time through your account settings or by contacting us.

6.3 Refund Policy

Subscription fees are non-refundable. If you cancel your subscription, you will not receive a refund or credit for any unused portion of your subscription period. However, you will retain access to subscription features until the end of the billing period.

6.4 Payment Information

You agree to provide accurate and complete payment information, and you authorize us to charge your payment method for subscription fees. If your payment method is declined, we may attempt to charge it again or suspend or terminate your subscription.

6.5 Pricing Changes

We reserve the right to change subscription prices with notice. Price changes will apply to new subscriptions and renewals after the notice period.

7. Disclaimer of Warranties

7.1 As Is Basis

The App is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2 No Guarantee

We do not warrant that the App will meet your requirements, be uninterrupted, timely, secure, or error-free, or that any defects or errors in the App will be corrected.

8. Limitation of Liability

8.1 No Liability for Damages

To the fullest extent permitted by law, Rwimbo Solutions, its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers or personal information
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or malware transmitted through the App
• Any errors or omissions in content or data
• The defamatory, offensive, or illegal conduct of any third party

8.2 Maximum Liability

In no event shall Rwimbo Solutions' aggregate liability for all claims related to the App exceed the amount paid by you to Rwimbo Solutions in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Rwimbo Solutions, its affiliates, officers, employees, agents, partners, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law principles.

10.2 Dispute Resolution

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration under the Nairobi Centre for International Arbitration Rules, which are deemed to be incorporated by reference into this clause.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us. Upon termination, you must cease all use of the App.

11.2 Termination by Us

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

11.3 Effect of Termination

Upon termination, all licenses and rights granted to you in these Terms will immediately cease, and you must destroy all copies of the App from your devices.

12. Miscellaneous

12.1 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

12.2 Entire Agreement

These Terms constitute the entire agreement between you and Rwimbo Solutions regarding the use of the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.

12.3 No Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Rwimbo Solutions' failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

12.4 Modifications

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the App or website. Your continued use of the App following such modifications constitutes your acceptance of the modified Terms.
